Completion of Fraud Investigation in Odesa
Law enforcement officials have concluded the pre-trial investigation and submitted an indictment to the court against the accused. He faces up to 12 years in prison with asset forfeiture.
The illicit actions of the individual were documented by investigators from the police department No. 2 of the Odesa District Police Department No. 1 in collaboration with officers from the Strategic Investigations Department in Odesa region.
According to the investigation, a 62-year-old resident of Odesa, acting in collusion with unknown individuals, attempted to seize the statutory capital of 6 million 700 thousand hryvnias of a limited liability company engaged in investment and construction, owned by a 71-year-old woman.
The suspect provided his personal information to his accomplices, who then created a forged power of attorney supposedly from the owner of the firm. This document granted the man the right to manage the corporate rights of the woman. The scheme was intended to end with the sale of these rights to a third party. However, when the perpetrator arrived with the buyer at the Odesa City Notary District to draft and certify the act of transfer of corporate rights, their activities were uncovered by a state notary and documented by the police.
As stated by the lead investigator in the case, Captain Stanislav Belykov, sufficient evidence was collected, including forensic conclusions, based on which the suspect was charged under two articles of the Criminal Code of Ukraine:
- Part 3, 4 of Article 358 – forgery of an official document issued by an authorized agency, as well as the use of knowingly forged documents;
- Part 5 of Article 190 – completed attempt to unlawfully acquire someone else's property through deception, i.e., fraud committed in collusion by a group of individuals in particularly large sizes.
The maximum penalty facing the perpetrator is twelve years of imprisonment with asset confiscation. The indictment has been submitted to the court. The Primorsky District Prosecutor's Office of Odesa will support the prosecution in court under the procedural guidance of which the pre-trial investigation was conducted.
