Justice in Construction: Sanctions for the Official

In the role of acting director of one of the departments, a public servant ignored a court's decision mandating the provision of documentation to a construction company for the design and construction of two residential complexes. The official faces penalties ranging from fines to imprisonment.
The illegal activities of the official were documented by investigators from the police department of the Odessa region under the supervision of the prosecutor's office.
During the investigation, it was established that a representative of a limited liability company, the owner of the land plot, had approached a department of the Odessa City Council for urban planning conditions for construction. However, the acting head of the department refused the service.
The organization's representative filed a lawsuit, based on which a court ruling declared the official's actions illegal, violating the company's rights to conduct business.
Courts, including the highest instances, ordered the official to comply with the ruling, yet he continued to avoid compliance, denying the company during repeated requests, citing circumstances already examined by judges and deemed baseless.
Eventually, the official provided the company with a construction permit, but limited the height to 30 meters instead of the 50 meters specified in the court ruling. Thus, the official again failed to execute the legally binding court decision.
After gathering evidence, investigators notified the official of suspicion under part 2 of Article 382 of the Criminal Code of Ukraine for intentional non-compliance with the court ruling, which had become legally binding, and obstructing its execution. The pre-trial investigation has been completed, and the indictment has been sent to court. The maximum penalty is up to five years of imprisonment, along with a prohibition from holding certain positions or engaging in specific activities for up to three years.
It is also noteworthy that a case regarding extortion and receiving illegal benefits by this same official for issuing urban planning conditions for facade reconstruction is currently under consideration in court.
