Odessa City Council's Urgent Appeal for Compensation Legislation
Members of the Odessa City Council have petitioned the Verkhovna Rada and the Cabinet of Ministers of Ukraine, requesting urgent legislative action to address compensation for damaged property for residents of buildings that are designated as cultural heritage sites.
Apartment owners in the damaged heritage buildings, like all other Ukrainian citizens, have the right to receive compensation for their damaged property in accordance with Ukrainian law regarding compensation for losses incurred due to military actions.
However, the provision of compensation to residents of damaged heritage buildings through the eRecovery system is hindered by specific legislative circumstances:
Firstly, the Cabinet of Ministers' resolution dated April 19, 2022, No. 473 does not extend to cultural heritage sites, which complicates the process of documenting damage and obtaining state compensation;
Secondly, the Cabinet of Ministers' resolution dated November 15, 2022, No. 1342, which establishes procedures for work on cultural heritage sites during wartime, does not regulate the compensation process but merely simplifies obtaining permits for work.
Throughout 2024, the executive committee of the Odessa City Council has made two appeals to the Ministry of Culture and the Ministry of Community Development regarding the need for amendments to these resolutions.
Yet, this nationwide issue remains unresolved.
Odessa City Council members have once again called upon central authorities for urgent legislative action to establish conditions for residents of cultural heritage buildings to receive compensation for their damaged property.
